Terms, Privacy &
Risk Disclaimer
Read these documents before subscribing. They define the terms of your relationship with IVIntel and the risks associated with options trading.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber," "you," or "your") and IVIntel ("IVIntel," "we," "us," or "our") governing your access to and use of the IVIntel Daily Edge newsletter and related services (collectively, the "Service").
By subscribing to or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Risk Disclaimer, both of which are incorporated herein by reference. If you do not agree to these Terms, do not subscribe to or use the Service.
2. Description of Service
IVIntel is an educational options signal newsletter service. The Service delivers daily emails containing market commentary, implied volatility analysis, and — for paid Tier 2 subscribers — options spread signals generated by the IVIntel scanning methodology.
The Service is offered in two tiers:
- Tier 1 (Free): Daily newsletter with market context, IV alerts, and signal activity summary. No actual trade signals (strikes, expiries, or entry prices) are provided at this tier.
- Tier 2 (Paid): All Tier 1 content, plus complete trade signals including ticker, strategy, strikes, expiration date, and entry price. Also includes open position updates, adverse and profit alerts, and daily dashboard access.
IVIntel is an educational information service. The Service does not provide investment advice, financial planning, brokerage services, or any service regulated by the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state securities regulator. See the Risk Disclaimer for the full scope of limitations on the Service.
3. Eligibility
You must be at least 18 years of age to subscribe to the Service. By subscribing, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. The Service is intended for use by residents of the United States. IVIntel makes no representation that the Service is appropriate or available for use outside the United States.
Tier 2 subscribers are responsible for ensuring they have the appropriate options trading approval level (minimum Level 2 or Level 3 options approval, which allows multi-leg spread trading) at their brokerage before placing any trade based on signals received through the Service.
4. Subscription, Billing, and Payment
4.1 Free Tier
Tier 1 subscriptions are free of charge. No payment information is required. You may unsubscribe at any time by using the unsubscribe link included in every newsletter email.
4.2 Paid Tier — Founding Member Rate
The first 100 Tier 2 subscribers ("Founding Members") are charged $19.00 per month ("Founding Rate"). This rate is locked in permanently for Founding Members as long as the subscription remains active. After the first 100 Founding Member spots are filled, subsequent Tier 2 subscribers are charged $29.00 per month ("Standard Rate"). IVIntel reserves the right to adjust the Standard Rate for new subscribers with 30 days' written notice. Founding Member rates are never increased.
4.3 Payment Processing
All payment processing is handled by Stripe, Inc. ("Stripe"), a third-party payment processor. IVIntel does not store, process, or have access to your credit card number or payment card data. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy. Stripe handles all aspects of PCI compliance on IVIntel's behalf.
4.4 Billing Cycle
Subscriptions are billed monthly on the date you first subscribed (your "billing date"). Your subscription automatically renews each month on your billing date unless you cancel prior to renewal. You authorize IVIntel and Stripe to charge your payment method on each billing date.
5. Cancellation and Refunds
5.1 Cancellation
You may cancel your Tier 2 subscription at any time. Upon cancellation, your paid access continues through the end of your current billing period. No partial refunds are issued for the unused portion of a billing period.
5.2 Founding Member Reinstatement
Founding Members who cancel and resubscribe within 30 calendar days of cancellation will have their Founding Member rate ($19/month) reinstated. Resubscriptions after 30 days are subject to the Standard Rate in effect at the time of resubscription.
5.3 Refund Policy
All subscription fees are non-refundable except where required by applicable law. IVIntel does not issue refunds for any portion of a billing period, including cases where no trade signals were sent during that period due to market conditions. If you believe you have been charged in error, contact IVIntel within 30 days of the disputed charge.
5.4 Free Trial
When a free trial period is offered, your payment method is charged on the first day after the trial ends unless you cancel before the trial concludes. Cancellation during a trial period ends access to Tier 2 features at the end of the trial with no charge.
6. Intellectual Property
All content delivered through the Service — including but not limited to newsletter text, trade signals, scanner methodology descriptions, dashboard HTML, charts, educational content, and the IVIntel brand — is the sole intellectual property of IVIntel. You are granted a limited, non-exclusive, non-transferable license to access and use Service content for your own personal, non-commercial informational purposes.
You may not reproduce, distribute, publicly display, resell, or create derivative works from Service content without prior written permission from IVIntel. Sharing paid Tier 2 content (including trade signals, strikes, expiries, or dashboard content) with non-subscribers is a material breach of these Terms and may result in immediate termination of your subscription without refund.
7. Prohibited Uses
You agree not to use the Service to:
- Resell, redistribute, or repackage IVIntel signals or content to third parties
- Operate a signal-forwarding service, trading group, or newsletter that derives its content from IVIntel signals
- Use automated tools to scrape, extract, or systematically collect Service content
- Impersonate IVIntel or misrepresent IVIntel's signals as your own analysis
- Violate any applicable federal, state, or local law or regulation in connection with your use of the Service
8. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IVIntel does not warrant that the Service will be uninterrupted, error-free, or that any signal will be profitable. IVIntel expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IVINTEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, TRADING LOSSES, OR DATA LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF IVINTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IVINTEL'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO IVINTEL IN THE THREE MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless IVIntel and its owners, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any trading decisions you make based on or in connection with Service content.
10. Termination
IVIntel reserves the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice. Grounds for termination include but are not limited to violation of these Terms, abuse of the Service, or fraudulent activity. Upon termination for cause, no refund will be issued for any remaining subscription period.
You may terminate your subscription at any time by canceling through the account management portal or by contacting IVIntel directly.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in [County] County, Texas, and you consent to personal jurisdiction in those courts.
Before filing any formal legal claim, you agree to provide IVIntel with written notice of the dispute and a 30-day opportunity to resolve it informally.
12. Changes to These Terms
IVIntel may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. IVIntel will provide at least 14 days' notice for material changes via email to the address on file with your subscription.
13. Entire Agreement
These Terms, together with the Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and IVIntel with respect to the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
1. Overview
IVIntel ("we," "us," or "our") is committed to protecting the privacy of our subscribers. This Privacy Policy explains what information we collect, how we use it, with whom we share it, and your rights with respect to that information.
By subscribing to the Service, you consent to the practices described in this Privacy Policy. If you do not agree to this policy, do not subscribe to the Service.
2. Information We Collect
2.1 Information You Provide Directly
- Email address — required to deliver the newsletter and all Service communications
- Subscription tier — Tier 1 (free) or Tier 2 (paid), stored to determine what content you receive
- Payment information — collected and processed exclusively by Stripe; IVIntel does not receive or store your credit card number, expiration date, or CVV
2.2 Information Collected Automatically
- Email engagement data — whether you opened an email or clicked a link, as reported by our email service provider (Resend). This helps us understand what content is most useful.
- IP address and browser information — collected when you visit ivintel.com. Used for security, analytics, and to detect fraudulent activity. Not linked to your identity for marketing purposes.
- Dashboard access logs — the daily dashboard is emailed as an HTML attachment and opened locally in your browser; no server-side tracking of dashboard views occurs.
2.3 Information We Do Not Collect
IVIntel does not collect your brokerage account information, trading account balances, positions, or any data from your personal brokerage account. We do not link any trading activity at your brokerage to your IVIntel subscription.
3. How We Use Your Information
We use the information we collect to:
- Deliver the IVIntel Daily Edge newsletter and all Service communications to your inbox
- Process and manage your subscription, including billing and renewal via Stripe
- Send Tier 2 trade signals, position updates, adverse alerts, and profit alerts
- Determine your subscription tier and deliver the appropriate content
- Manage Founding Member status and rate eligibility
- Respond to account inquiries or billing disputes
- Analyze email engagement to improve the quality and relevance of Service content
- Comply with applicable legal obligations
We do not sell your email address or personal information to third parties. We do not use your information for behavioral advertising, cross-site tracking, or any purpose unrelated to delivering the Service.
4. Third-Party Service Providers
We share limited information with the following third-party providers solely to operate the Service:
- Stripe, Inc. — Payment processing. Receives your payment card data directly (IVIntel does not). Stripe's privacy policy governs how Stripe handles your payment data. See stripe.com/privacy.
- Resend — Email delivery. Receives your email address and the content of each newsletter or alert email. Resend processes emails on our behalf and logs delivery and engagement data (opens, clicks).
- Supabase — Subscriber database. Stores your email address, subscription tier, subscription status, and join date in a hosted Postgres database. Supabase does not have access to payment data.
- Vercel — Website hosting and content delivery. Serves ivintel.com pages to your browser. Vercel may log server access requests including IP address and browser type for security and performance purposes.
- Hostinger — Domain registrar for ivintel.com. Hostinger does not receive subscriber data.
We do not authorize any of these providers to use your information for any purpose other than providing services to IVIntel.
5. Email Communications
By subscribing to Tier 1, you consent to receiving the IVIntel Daily Edge newsletter on every trading day the Service operates. By subscribing to Tier 2, you additionally consent to receiving trade signals, position update emails, adverse alerts, and profit alerts.
Every newsletter email includes an unsubscribe link at the bottom. Clicking this link will immediately remove you from the mailing list. You may also unsubscribe by contacting IVIntel directly. Unsubscribing from the newsletter cancels your Tier 1 subscription. Tier 2 subscribers who unsubscribe from email will no longer receive Service content; subscription fees are not refunded for periods already billed.
We do not send promotional, advertising, or third-party marketing emails. The only emails you receive from IVIntel are Service-related: the daily newsletter, trade signals, intraday alerts, and transactional messages (billing receipts, subscription confirmations, and account notifications).
6. Data Retention
We retain your email address and subscription data for as long as your subscription is active. If you unsubscribe and request deletion of your data, we will delete your email address and subscription records within 30 days, except where retention is required by law (for example, billing records required for tax purposes are retained for a minimum of 7 years).
Email delivery and engagement logs maintained by Resend are subject to Resend's data retention policy and are not within IVIntel's direct control.
7. Data Security
We take reasonable measures to protect subscriber data from unauthorized access, disclosure, or misuse. These measures include:
- Encrypted connections (HTTPS) for all web and API communications
- API keys and credentials stored in environment variables, never in source code
- Access to subscriber data limited to the systems necessary to operate the Service
- Payment data handled exclusively by Stripe and never transmitted to or stored by IVIntel
No system is completely secure. In the event of a data breach affecting your information, we will notify affected subscribers within 72 hours of becoming aware of the breach, to the extent required by applicable law.
8. Your Rights
Depending on your location, you may have the following rights with respect to your personal information:
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate personal data
- Deletion: Request deletion of your personal data (subject to legal retention requirements)
- Portability: Request your data in a machine-readable format
- Opt-out: Unsubscribe from email communications at any time via the unsubscribe link in any newsletter
To exercise these rights, contact IVIntel at the email address associated with your subscription. We will respond within 30 days.
9. Children's Privacy
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we learn that we have inadvertently collected personal information from a subscriber under 18, we will delete that information promptly.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the Service after the effective date of any change constitutes acceptance of the updated policy.
11. Governing Law
This Privacy Policy is governed by the laws of the State of Texas. Any disputes relating to privacy practices shall be resolved in the courts of [County] County, Texas.
READ THIS DISCLAIMER IN FULL BEFORE SUBSCRIBING TO OR USING THE IVINTEL SERVICE. Options trading involves a substantial risk of loss and is not appropriate for all investors. The information provided by IVIntel does not constitute investment advice and is provided for educational and informational purposes only. You may lose some or all of the capital you invest.
1. Not Investment Advice
IVIntel and its owner are not registered investment advisers, broker-dealers, financial planners, or commodity trading advisors under federal or state law. IVIntel is not registered with or regulated by the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the Commodity Futures Trading Commission (CFTC), or any state securities regulator.
Nothing in the IVIntel Daily Edge newsletter, trade signals, dashboard, website, or any other communication from IVIntel constitutes investment advice, financial advice, trading advice, or a recommendation to buy, sell, or hold any security or financial instrument. All Service content is provided for educational and informational purposes only.
Before making any investment or trading decision, consult a licensed financial adviser, investment adviser, or broker-dealer registered in your state who can take into account your individual financial situation, investment objectives, risk tolerance, and tax circumstances.
2. Options Trading Risk
Options are complex financial instruments that carry significant risk of loss. Options trading is not suitable for all investors. Before trading options, carefully consider your investment objectives, financial resources, and tolerance for risk. You should be aware of the following risks inherent to options trading:
- Total loss of premium: When buying options, you can lose 100% of the premium paid if the option expires worthless.
- Risk of defined-loss spread strategies: Although defined-risk spread strategies (such as vertical spreads) cap the maximum loss at a known amount, you can lose the full maximum risk on any individual trade.
- Margin and assignment risk: Spread positions that are not managed prior to expiration may be subject to early assignment, exercise, or automatic exercise. Failing to close expiring in-the-money options may result in unintended stock or obligation exposure.
- Liquidity risk: Options on some underlyings may have wide bid-ask spreads or insufficient volume, resulting in executions materially different from the signal entry price.
- Gap risk: Overnight or weekend gaps in the underlying stock price can cause losses that exceed the stop-loss level at which a position would otherwise have been closed.
- Earnings and event risk: Unexpected earnings announcements, corporate actions, or macroeconomic events can cause rapid, large moves in the underlying that may result in losses that exceed modeled expectations.
- Volatility crush: After an anticipated event passes, implied volatility can drop sharply, causing option values to decline even if the underlying moves in the expected direction.
- Time decay: Options lose value over time as expiration approaches. Positions that are not yet profitable may deteriorate in value even without adverse movement in the underlying.
3. Paper Trading Disclosure
All IVIntel trade signals are currently tracked in a simulated paper trading account. Paper trading uses no real capital. No actual securities transactions have been executed in connection with the IVIntel track record.
The IVIntel track record reflects the performance of the IVIntel methodology applied to hypothetical trades under simulated market conditions. Entry and exit prices are based on live option chain data at the time each signal is generated, using mid-price approximations at signal generation and exit rule trigger times. However:
- Simulated results do not reflect the impact of actual execution, including bid-ask spreads, partial fills, slippage, and market impact.
- Orders placed in a live account may be executed at prices materially different from the simulated entry or exit prices reflected in the track record.
- Paper trading results do not reflect taxes, transaction fees, or other costs that would be incurred in a live trading account.
- The ability to execute trades at the prices shown in the track record is not guaranteed.
SIMULATED OR HYPOTHETICAL TRADING RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT OF CERTAIN MARKET FACTORS SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
4. Past Performance Disclaimer
Past performance of the IVIntel methodology, whether based on paper trading results or any future live trading record, is not indicative of future results.
The win rates, cumulative P&L figures, and other performance statistics presented in the IVIntel track record represent historical outcomes under specific market conditions. Market conditions change continuously. There is no guarantee that the IVIntel methodology will continue to perform similarly to its historical results, that future signals will have the same win rates as historical signals, or that any particular signal will be profitable.
Even a methodology with a documented historical win rate above 60% will produce consecutive losing trades. No trading system eliminates the possibility of loss, and no system or signal service eliminates the need for individual risk management on the part of the subscriber.
5. Subscriber Responsibility
You are solely responsible for all trading decisions, position sizing, order entry, order management, and exit decisions made in your own brokerage account. IVIntel provides signals and market analysis as information — not instructions. IVIntel does not manage your account, execute trades on your behalf, or have any authority over or visibility into your personal brokerage account.
Specifically, you are solely responsible for:
- Deciding whether to place any trade based on an IVIntel signal
- Determining an appropriate position size for your account size and risk tolerance
- Entering orders correctly in your brokerage account, including strike selection, expiration selection, and order type
- Monitoring open positions and making exit decisions independent of IVIntel's paper trading track record
- Managing risk within your account, including the use of stop orders, exit orders, or other risk management tools your brokerage provides
- Understanding that intraday alerts from IVIntel are informational only — they describe where a position stands in IVIntel's paper trading account, not a recommendation that you exit or hold your personal position
6. No Guarantee of Results
IVIntel makes no guarantee, representation, or warranty of any kind that subscribers who place trades based on IVIntel signals will achieve any particular level of profit, replicate the results shown in the IVIntel paper trading track record, or avoid losses. Individual subscriber results will vary based on execution timing, account size, position sizing, brokerage fees, and market conditions at the time of execution.
The IVIntel methodology is designed to identify high-probability options spread setups based on implied volatility rank, historical candlestick pattern win rates, and defined-risk spread structures. These factors provide a statistical edge over a large sample of trades but do not eliminate the probability of individual losing trades or periods of drawdown.
7. Options Approval Requirement
The trade strategies described in IVIntel signals — including bear put spreads, bear call spreads, bull put spreads, and bull call spreads — are multi-leg options spread strategies that require approval for spread trading at your brokerage (typically Level 2 or Level 3 options approval). Not all brokerage accounts are approved for these strategies.
You are responsible for confirming that your brokerage account is approved for the relevant options trading level before placing any trade. IVIntel does not verify subscriber brokerage approval levels and cannot be held responsible for trades that cannot be placed due to insufficient options trading approval.
8. Educational Purpose of Signal Content
The IVIntel Daily Edge newsletter and trade signals are designed to help subscribers understand the IVIntel methodology, learn about options spread strategies and implied volatility analysis, and observe how the methodology is applied across a range of market conditions. The publication of signals is intended to illustrate the methodology in real time — it is not intended as a directive to place any particular trade.
IVIntel encourages all subscribers to use Service content as a learning tool and to develop their own understanding of options strategy, risk management, and market analysis. Blindly copying any signal service without understanding the underlying strategy and risks is not consistent with responsible trading practice.
9. Limitation of Liability for Trading Losses
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IVINTEL AND ITS OWNER SHALL NOT BE LIABLE FOR ANY TRADING LOSSES, INVESTMENT LOSSES, OR OTHER FINANCIAL DAMAGES INCURRED BY ANY SUBSCRIBER IN CONNECTION WITH THEIR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSSES ARISING FROM PLACING TRADES BASED ON IVINTEL SIGNALS, FAILING TO RECEIVE A SIGNAL DUE TO TECHNICAL ISSUES, OR ACTING ON OR RELYING UPON ANY INFORMATION IN THE IVINTEL DAILY EDGE NEWSLETTER OR ANY OTHER SERVICE COMMUNICATION.
10. Governing Law
This Risk Disclaimer is governed by the laws of the State of Texas. Any disputes arising under or relating to this disclaimer shall be resolved in the courts of [County] County, Texas.
